TERMS AND CONDITIONS

South Florida Pumpkin Decor LLC

Last updated: October 17, 2026

AGREEMENT

These Terms and Conditions govern all seasonal decor design, sourcing, installation, maintenance, and removal services provided by South Florida Pumpkin Decor LLC (\"we,\" \"us,\" \"our\") to the client (\"you,\" \"your\"). By approving a quote, submitting payment, or permitting us to perform services at your property, you agree to these terms.

SERVICES

We provide seasonal decorative displays consisting of pumpkins, gourds, squash, hay, straw, corn stalks, botanicals, foliage, and related decorative materials, installed at residential and commercial properties within our service area. Services are offered as published packages or as custom displays quoted individually.

Package contents represent a design plan, not a fixed inventory list. Quantities, varieties, and sizes may be substituted to achieve the intended scale, palette, and overall design based on seasonal availability.

QUOTES AND PRICING

Quotes are valid for 3 days from the date of issue and reflect material, fuel, and market costs as of that date. After 3 days, pricing is subject to change and must be re-confirmed before scheduling.

Once approved, your price is locked. We will not adjust the total on an approved quote. If a sourcing issue affects specific line items, we will contact you before your install date and either substitute comparable materials at no additional cost or refund the affected portion.

All pricing is exclusive of applicable Florida state sales tax and county discretionary sales surtax, which will be added to your invoice.

PAYMENT

Full payment is due at the time of booking. Your installation date is reserved only once payment is received.

We collect in full because every display is sourced specifically for your property. Once your date is confirmed, we purchase your materials, reserve your installation window, and decline other bookings for that date. Pumpkins, gourds, and botanical materials are perishable and cannot be returned, resold, or held for a later season.

Accepted payment methods are listed on your invoice. Returned payments and failed transactions may incur a fee.

CANCELLATION AND RESCHEDULING

Within 48 hours of booking: If you cancel within 48 hours of approving your quote, and before we have begun sourcing, we will refund your payment in full.

After 48 hours: Payment is non-refundable, as materials have been purchased and your date has been held.

Rescheduling: We will make reasonable efforts to accommodate a new date if you contact us at least 7 days before your scheduled installation, subject to availability. Materials already sourced for your original date may require replacement at your cost, which we will quote before proceeding.

If we cancel: If we are unable to perform your installation for any reason within our control, you will receive a full refund. Weather delays are governed by Section 10 and are not cancellations.

PERISHABLE MATERIALS AND DISPLAY LIFE

You acknowledge that all decorative materials used in your display are natural agricultural products. They are perishable and will change in appearance over time. Softening, discoloration, mold, insect activity, splitting, stem loss, and decay are normal and expected outcomes, particularly in South Florida heat, humidity, and rainfall.

We treat and prepare materials to extend display life, but we do not warrant or guarantee any specific display duration. Display longevity varies substantially based on weather, sun exposure, irrigation, surface material, airflow, wildlife, and factors outside our control.

Deterioration of natural materials is not a defect and does not entitle you to a refund, replacement, or credit except as expressly provided in Section 7.

TOUCH-UP AND MAINTENANCE SERVICES

Refresher Service (Installation Care and Touch-up window): Before date and time of specified installation, all materials are sanitized, cleaned, and inspected for any structural issues such as mold, fungus, and rot. If a material failure occurs within 3 business days of installation, contact us and we will replace the specified item at no charge and at our earliest availability. Requests made after 5 business days are handled as paid maintenance and serviced by our Refresher service.

Where purchased, maintenance or refresher visits include removal of decaying material, cleanup of debris, and replacement of deteriorated items. Replacement is limited to a reasonable number of items consistent with the scope and value of your original display and as determined by South Florida Pumpkin Decor LLC installation personnel. Replacement of more than 20% of the original installation in a single visit, or any replacement resulting from causes listed in Section 9, may be quoted separately before work proceeds.

Maintenance services do not extend the display life warranty, as none is provided.

PROPERTY ACCESS AND SITE CONDITIONS

You are responsible for providing safe, lawful, and unobstructed access to the installation area on your scheduled date, including any gate codes, parking arrangements, association approvals, or building permissions required.

If we arrive and cannot access the property or perform the installation due to conditions within your control, the visit may be rescheduled at our discretion and additional trip charges may apply.

You are responsible for obtaining any homeowners association, condominium association, or landlord approval required for your display. We are not responsible for fines, removal orders, or penalties issued by such entities.

PROPERTY PROTECTION AND DAMAGE

We take reasonable care to protect surfaces, landscaping, and finishes during installation, including the use of risers and protective materials where appropriate.

You acknowledge that natural materials placed on porous surfaces including but not limited to stucco, travertine, coral stone, pavers, wood decking, and painted concrete may cause staining or discoloration as they break down. We are not responsible for staining, marking, etching, or surface damage resulting from the ordinary presence or decomposition of display materials.

We are not responsible for loss or damage caused by theft, vandalism, tampering, pets, wildlife, insects, guests, third-party contractors, lawn or pool services, irrigation systems, or acts of nature.

WEATHER AND STORMS

Installation and service dates are subject to weather. We may reschedule for rain, lightning, extreme heat, high wind, or any condition we determine unsafe. Rescheduled dates are assigned based on availability and are not cancellations.

In the event of a named tropical storm, hurricane watch, or hurricane warning affecting our service area, you are responsible for securing or removing display materials at your property. Display materials can become projectiles in high wind. We are not liable for damage, injury, or loss caused by display materials during such events, and we may remove or secure displays at our discretion without prior notice where safety requires it.

Materials lost, damaged, or destroyed in a storm event are not covered and replacement will be quoted separately.

REMOVAL AND CLEANUP

Cleanup and removal services are included only where expressly stated on your quote or purchased as an add-on. Where cleanup is not purchased, all display materials become your property upon installation and disposal is your responsibility.

Where cleanup is purchased, we will remove installation materials and decaying organic matter and perform a general cleanup of the installation area. Removal of materials not supplied by us, or materials incorporated into the display by others, may be quoted separately.

PHOTOGRAPHY AND MARKETING

We may photograph completed installations for our portfolio, website, and marketing. We treat client privacy and security seriously. Published photos will not include street addresses, house numbers, license plates, identifying signage, or the names of occupants, and we remove any such details that may present as a reasonable concern. We do not publish images of minors without written consent from a parent or guardian.

If you prefer that your property not be photographed, published, or referenced on social media, contact us at info@southfloridapumpkindecor.com before your installation date or within 48 hours after an event has ended and we will respectfully honor your request. If you later ask us to remove a published image, we will take it down from our website and social accounts promptly.

If you ask us to remove an image after it has been published, we will take it down from our website and social media promptly. Printed materials already distributed cannot be recalled, but we will not use the image in any future materials. We will not use photos of your home in paid advertising without a signed photo release. Photo release forms are available on request.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, our total liability arising out of or relating to these terms or any services provided shall not exceed the total amount you paid for the services giving rise to the claim.

We shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of use, loss of enjoyment, or damages arising from event disruption, under any theory of liability.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless South Florida Pumpkin Decor LLC, its members, employees, and contractors from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your breach of these terms, your failure to obtain required approvals, or injury or damage occurring at your property in connection with the display after installation is complete.

FORCE MAJEURE

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including weather, natural disaster, crop failure, supplier shortage, transportation disruption, labor shortage, utility failure, government action, or public health emergency.

GOVERNING LAW AND VENUE

These terms are governed by the laws of the State of Florida without regard to conflict of law principles. Any dispute arising under these terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

DISPUTE RESOLUTION

Before initiating any legal proceeding, you agree to first contact us in writing and allow 30 days to resolve the matter in good faith.

SEVERABILITY

If any provision of these terms is held unenforceable, the remaining provisions remain in full force and effect.

ENTIRE AGREEMENT

These terms, together with your approved quote, constitute the entire agreement between the parties and supersede all prior discussions, proposals, and representations, whether written or oral.

CHANGES TO THESE TERMS

South Florida Pumpkin Decor LLC reserves the right to update these terms at any time. The version in effect is based on date of payment related to your quote or invoice.
